"A man who may have suffered sexsomnia, which caused him to have sex with a woman while he was asleep, has been found not guilty of rape. Leonard Andrew Spencer, 48, was accused of gross indecency and sexual intercourse without consent.
The NT Supreme Court heard this week he entered the bedroom of a guest at his home in Nhulunbuy in Arnhem Land in the early morning of June 2 last year. The court heard Mr Spencer went into the room about 7.20am and hopped into the woman's bed.
His lawyer, Jon Tippett QC, argued he was asleep at the time and there was not enough evidence to suggest a sexual assault took place. Mr Spencer was adamanant he was innocent, saying he had no recollection of the event.
Psychiatrist Lester Walton told the court via video-link that Mr Spencer may have suffered the condition 'sex-sleep'. Dr Walton said memory loss was 'a hallmark of somnambulist behaviour', which was 'better known as sleepwalking but includes sleeptalking and a range of other activities.'"
